These Terms of Service ("Terms") govern your use of the Domus21.ng website and platform ("Domus21", "we", "us", "our"), operated by Domus21 Inc. By accessing or using Domus21, you agree to these Terms. If you do not agree, do not use the platform.

Note: Approved as final by the business owner on 23 September 2026.

1. What Domus21 Is — and Is Not

  1. Domus21 is an online marketplace and advertising venue that allows property agents, developers, and homeowners ("Listers") to publish property listings, and allows the public ("Buyers") to browse those listings and contact Listers.
  1. Domus21 is not a party to any transaction, negotiation, agreement, or dispute between a Buyer and a Lister. Domus21 does not own, sell, buy, lease, inspect, value, or warrant any property listed on the platform.
  1. Domus21 is not an estate agent and does not provide estate agency, valuation, legal, or financial advice. Nothing on this platform should be relied upon as professional advice.
  1. Any agreement for the sale, lease, or purchase of a property is made solely between the Buyer and the Lister. Domus21 has no obligation to complete, enforce, or guarantee any such agreement.

2. Listings and Content

  1. Listers are solely responsible for the accuracy, completeness, legality, and currency of their listings, including prices, photographs, descriptions, measurements, title documents, and availability.
  1. Domus21 does not routinely verify listings. Listings are published on an "as is" basis. Any verification badges or labels displayed on the platform relate only to the checks described alongside them and do not constitute a guarantee of the property or the transaction.
  1. Listings marked "Sample" are demonstration content for layout and testing purposes only and do not represent real properties or real offers.
  1. Domus21 may, at its sole discretion, remove or refuse any listing that appears inaccurate, misleading, unlawful, or in breach of these Terms, without prior notice and without liability.

3. Lister Obligations

  1. Listers warrant that they are legally entitled to market each property they list and that all information supplied is true and not misleading.
  1. Listers offering agency services represent that they hold the professional credentials required under Nigerian law, including registration with the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON) where applicable.
  1. Listers must not publish listings for properties they have no authority to market, and must promptly remove or update listings that are sold, let, withdrawn, or materially changed.

4. Buyer Obligations

  1. Buyers use the platform at their own risk and are responsible for conducting their own due diligence — including physical inspection of properties, verification of title documents, and independent legal advice — before entering into any transaction.
  1. Buyers must not misuse the platform, harvest Lister contact details for unsolicited marketing, or submit false enquiries.

5. No Handling of Funds

  1. Domus21 does not receive, hold, transfer, or escrow any money in connection with property transactions. All payments are made directly between Buyers and Listers through channels they arrange themselves.
  1. Domus21 is not responsible for any loss arising from payment arrangements made between users, including fraud, failed transfers, or misdirected funds.

6. Disclaimers

  1. The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, reliability, uninterrupted availability, or fitness for a particular purpose.
  1. Domus21 does not warrant that listings are accurate, that properties remain available, that Listers are reputable, or that transactions will complete successfully.

7. Limitation of Liability

  1. To the maximum extent permitted by law, Domus21, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
    • (a) any transaction, failed transaction, or dispute between users;
    • (b) reliance on any listing or content on the platform;
    • (c) the conduct, representations, or omissions of any Lister or Buyer;
    • (d) loss of money, property, or opportunity connected with use of the platform.
  1. Nothing in these Terms excludes liability that cannot be excluded under the laws of the Federal Republic of Nigeria.

8. Indemnity

  1. You agree to indemnify and hold harmless Domus21, its directors, officers, employees, and affiliates against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your listings or content, or your transactions with other users.

9. Reporting and Enforcement

  1. Users may report inaccurate, misleading, or suspicious listings via the reporting function on the platform or by emailing Contact@domus21.ng.
  1. Domus21 may suspend or terminate accounts, remove listings, and restrict access for breach of these Terms, without prior notice and without liability.

10. Dispute Resolution

  1. Any dispute arising from these Terms or your use of the platform shall first be addressed through good-faith negotiation for 30 days.
  1. Failing settlement, disputes shall be resolved by arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act, 2023. The arbitral award shall be final and binding.

11. Governing Law

  1. These Terms are governed by the laws of the Federal Republic of Nigeria.

12. Changes to These Terms

  1. We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
